Terms of Service:
The following terms apply to all accounts and clients of
PavementWeb and are considered to be accepted by your placement of
an order with us. These are binding on your service with us, please
read carefully.
Payment for Services:
PavementWeb, like all hosting companies, requires payment in advance
for the coming month.
Accounts are considered past
due after the 5th day and may or may not receive
reminders as a courtesy.
After the 5th day of an unpaid invoice your
service may be suspended at any time at our discretion and a $10 reactivation fee
plus the current charges must be paid before service is restored.
We accept payments by Pay Pal®, Visa or MasterCard. Because of our value pricing
structure there are no discounts for pre-payment or overpayment and
this is discouraged because our accounting system is based on
monthly charges.
Content:
All services provided by PavementWeb may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material,
any material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless PavementWeb Services from any claims resulting from the use of the service which damages the subscriber or any other party.
Examples of non-acceptable content or links include but are not
limited to:
• Pirated software
• "Illegal MP3's"
• Hackers programs or archives
• Warez Sites
• Pornography of any type
• Slanderous or libelous content
PavementWeb will be the sole arbiter as to what constitutes a violation of this
provision.
Unlimited Traffic/Hits & Server Resource Usage:
PavementWeb is pleased to offer our clients unlimited traffic/hits, and server usage. Unlimited Traffic/Hits refers to the number of visitors to your website, NOT the amount of bandwidth/data transfer. Your account is still limited to the
allotted bandwidth/data transfer included with your selected package. To maintain the integrity of our service the following traffic/usage limitations apply.
• Sites with banners, graphics or cgi's running from their domain being used on other domains.
• Sites with immense graphic archives or galleries.
• Sites offering immense download archives, such as .zip, .tar, .ra and .GZ.
• Sites running large chat room gatherings.
• Sites using more than 20% of system resources
If you do not qualify for unlimited traffic/hits, your account may be required to be upgraded.
Guarantee of resources:
PavementWeb never engages in the all-to-common practice of
"overselling" our server resources. Your level of
storage and bandwidth will be available
to you 24/7/365. If we gain so many customers that we run out of
room we will add another server. It's a simple as that.
We host more pavement web sites than any single firm, and some are
very active. We pride ourselves on the fast & dependable performance
we deliver. As of April 1, 2006 our system has not experienced any
downtime for 159 days (100% uptime) and the downtime 160 days ago
was scheduled maintenance for upgrades/security less than 30 minutes
at 3am on a week-end morning. No customer was adversely affected.
Chat Rooms:
Some PavementWeb plans allow clients to install their own chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause. We do provide a html based cgi chatroom
with some plans that runs without hindering the performance of the machine for others. You are free to run your own chat script, as long as it does not hinder server performance.
Background Processes/Programs
PavementWeb may allow programs to run continually in the background, these are considered on a one to one basis and a extra charge may be incurred based on system resources used and operational maintenance needed.
Cron Jobs:
PavementWeb does allow Cron Jobs to be conducted on our servers.
IRC:
PavementWeb does not allow IRC or IRC bots to be operated on our servers.
Multiple Connections:
Multiple ftp sessions are allowed, on a single hosting account if included in your plan.
Most of our users only require one.
Idle Timeouts:
PavementWeb may disconnect any idle connection to the network.
Average timeouts are:
FTP - 300 seconds
IMPORTANT Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from any PavementWeb account or
using an email address that is maintained on the PavementWeb system
is STRICTLY prohibited.
For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.
PavementWeb will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is acceptable, as long as Opt-Out/Removal request are fully honored. Please make an effort to limit outgoing mail on your account to no more than 200 pieces per DAY and no more than 25 pieces per minute. Large mailings are preferred to be sent from the hours of 12AM - 8AM EST. Sites with very large mailing databases, need to be placed on another service. We can gladly recommend one
